A FEW OF THE AMENDMENTS AND BILLS BUBBLING UP FOR DEBATE,
ALLOWING CITIES TO SET CURFEWS; PUSH FOR OPEN PRIMARIES;
SO-CALLED THREE STRIKES BILL WE HAVE TALKED ABOUT HERE.
SO, JOINING ME TODAY AT THE LINE TABLE TO TALK ABOUT THESE AND

CURFEWS PASSED THE HOUSE REGULATORY AND PUBLIC AFFAIRS
COMMITTEE ON MONDAY. THAT BILL PROMPTED BY SOME HIGH
PROFILE SHOOTINGS, AS YOU KNOW, HAS ITS BACKERS BUT ALSO
CRITICS. SUPPORTERS SAY IT WOULD PROTECT
THE COMMUNITY AND MAY HELP KEEP YOUTH IN SCHOOL, WHILE SOME WHO
OPPOSE IT SAY IT CRIMINALIZES THE YOUNG AND COULD LEAD TO
INCIDENTS OF RACIAL PROFILING. INTERESTING DEBATE TO LISTEN TO,
I STREAMED IT ON MONDAY AFTERNOON.
IT PASSED BY A 4-3 VOTE.>>PARTISAN VOTE, RIGHT.
>>INTERESTING TO HEAR THE DEBATE THOUGH.
THERE COULD NOT HAVE BEEN MORE FACTUAL EVIDENCE PUT OUT THERE
IN FRONT OF THIS COMMITTEE THAT, IN FACT, CURFEWS DON’T SEEM TO
WORK AS THE SCIENCE AS WE HAVE IT, HOWEVER, IT STILL GOT LEGS.
>>IT IS LIKE A VERY APPEALING TOPIC AND IT FEELS LIKE A SILVER
BULLET TO SOME PORTION OF THE ALBUQUERQUE — I IMAGINE NEW
MEXICO POPULATION THAT IS LOOKING AT HIGH PROFILE CRIMES
OF THE PAST COUPLE OF YEARS INVOLVING JUVENILE OFFENDERS AND
IN THE ABSENCE OF MORE EFFECTIVE BETTER LEGISLATION, WE ARE KIND
OF STUCK WITH THESE SORT OF INEFFECTIVE, FRANKLY, OPTIONS
LIKE THE TEEN CURFEW. THERE IS SOME ARGUMENT TO BE
MADE NOT JUST IT IS INEFFECTIVE BUT IT IS COUNTERPRODUCTIVE.
AND WE SEE OTHER COMMUNITIES, OTHER STATES, REALLY MOVING IN
THE OPPOSITE DIRECTION, JUST AS WE DO WITH THE OTHER CRIME BILLS
THAT ARE IN FRONT OF THE LEGISLATURE THIS YEAR.
IT DOES FEEL VERY RETRO THIS YEAR IN SANTA FE.
SO WHEN WE LOOK AT TEEN CURFEWS, WHEN WE LOOK AT OTHER SIMILAR
ISSUES, I THINK IT IS REALLY IMPORTANT FOR THE ELECTORATE,
FOR FOLKS WATCHING THE NEWS, FOLKS WATCHING US HERE TODAY TO
FOCUS ON WHAT IS EFFECTIVE, AS OPPOSED TO WHAT IS GOING TO FEEL
GOOD. BECAUSE WHAT IS GOING TO FEEL
GOOD MAY NOT LEAD TO OUTCOMES WE WANT.
WE END UP FEELING WORSE. WE NEED THINGS THAT MAKE A
DIFFERENCE AND UNFORTUNATELY CURFEWS DON’T.
INTERDICTION DOES. SO, DRUG AND ALCOHOL COUNSELING,
TEEN PROGRAMS, THINGS THAT KEEP KIDS ACTIVE AND ENGAGED RATHER
THAN KEEPING THEM AT HOME.>>ONE CANNOT BLAME ANY
LEGISLATOR FOR WANTING TO REACT TO A PROBLEM THAT IS HAPPENING
ON THE STREETS OF THEIR DISTRICT.
NOBODY CAN FAULT ANYBODY FOR THAT.
HOWEVER, IN YOUR OPINION, I’M CURIOUS HOW YOU THINK ABOUT THE
APPROACH TO TEEN CURFEWS AND SPECIFICS.
WE’LL GET TO THE OTHER STUFF, BUT FOR TEEN CURFEWS, DO YOU
SUPPORT THAT, AND IF NOT, WHY?>>ON THE FACE OF IT I
ABSOLUTELY DO. I WOULD THINK THAT TEENS NEED TO
BE AT HOME. NOTHING GOOD HAPPENS AFTER
MIDNIGHT.>>I HEAR THAT A LOT, THAT
NOTHING HAPPENS GOOD FOR TEENS AFTER MIDNIGHT.
I REMEMBER BEING A TEENAGER AFTER MIDNIGHT.

MANAGE, TO YOUR POINT WHICH IS EXACTLY THE FACT THAT HOW ARE
THEY GOING TO HAVE TO RESPOND TO LEVEL 1, LEVEL 2 CALLS OR
WHETHER OR NOT JOHNNY IS OUT AT A 1:00 BECAUSE HE WANTS TO
HANGOUT WITH MARY ANN. IT SEEMS LIKE THERE ARE MORE
IMPORTANT THINGS FOR THE LEGISLATURE TO FOCUS ON.
I UNDERSTAND WHY IT IS BEING PUT OUT THERE, ESPECIALLY IN LIGHT
OF A RECENT — IT IS LIKE ONE OF THEIR FAMILIES OWN UNDER THE AGE
OF 17 CAME OUT, SO IT IS LIKE WE SUDDENLY HAVE TO WORRY ABOUT
THIS. I DON’T KNOW THAT REALLY NEEDS
TO BE A PRIORITY AND GIVEN KIND OF THE GOVERNOR’S OVERALL KIND
IMPETUS ON CRIME AND PUNISHMENT AND FOCUS ON THAT, THIS FEELS
LIKE TEEN CURFEW IS LUMPED INTO THAT AND I DON’T LIKE THAT

THE THINGS THAT CAME UP AND WE WILL MOVE ON FROM TEEN STUFF IN
A SECOND, WHAT WAS INTERESTING TO ME LISTENING TO THE DEBATE,
THERE WAS OPEN QUESTIONS ABOUT, OKAY, LET’S ACTUALLY WALK THIS
THROUGH REALITY. A TEENAGER GETS PICKED UP, THEY

BUT CONSTITUTIONALLY THIS SEEMS TRICKY.

SYMBOLIC. IT’S A SYMBOLIC ISSUE ABOUT
DEALING WITH THESE PROBLEMS. HOW DO YOU DEAL WITH THOSE
PROBLEMS? RIGHT?
ONE THING WE CAN DO IS CREATE A CURFEW.
WE GO BACK TO CONSTITUENTS AND SAY WE HAVE DONE SOMETHING AND
WE’RE WORKING TOWARDS A GOAL. SO IT IS SYMBOLIC MORE THAN
SUBSTANTIVE.>>WE HAD A ORDINANCE HERE FOR
CURFEW HERE. AND IT GOT –>>STRUCK DOWN BY NEW MEXICO
SUPREME COURT. I CAN SEE LIKE SAID, I CAN SEE
THE FRUSTRATION PEOPLE HAVE. IT HAS BEEN A ROUGH 2015 WHEN IT
COMES TO CRIME. FROM THE LIBERTARIAN STANDPOINT,
I AM LITTLE WORRIED OR CONCERNED ABOUT CURFEW.
IT IS A HEAVY HAND IMPETUS GOVERNMENT.
BUT, IN FAIRNESS THOUGH I CAN SEE WHERE THE FRUSTRATIONS COMES
FROM AND THIS BILL, WHICH IS SPONSORED BY A REPUBLICAN AND A
DEMOCRAT, REPUBLICAN NATE GENTRY, AND DEMOCRAT KARL
TRUJILLO FROM SANTA FE COUNTY, I THINK THEY DID — I THINK THE
BILL WAS ACTUALLY FAIRLY WELL CRAFTED FROM A POLITICAL
STANDPOINT. FOR EXAMPLE, IF YOU’RE 16 OR
OLDER, YOU’RE EXEMPT FROM THIS. AND I THINK THAT APPEALS TO
PEOPLE. WELL, YEAH, IF YOU’RE A 12 YEAR
OLD OUT AFTER 2:00 IN THE MORNING, YEAH, MAYBE YOU SHOULD
GET PICKED UP. BUT, I STILL FEEL A LITTLE
UNCOMFORTABLE WITH IT.>>LET ME GO TO ANOTHER ONE,
EDDY. INTERESTING, THE IDEA IMPETUS
HAVING OPEN PRIMARIES IS BACK AGAIN.

I AM VERY INTERESTED IN THAT. I TELL YOU, THIS IS TO LONNA AS
WELL, I THINK THE STATE OF NEW MEXICO PAYS FOR PRIMARIES LIKE
IT DOES THROUGHOUT THE REST OF THE COUNTRY.
THIS IS A TAXPAYER FUNDED OPEN PRIMARY.
THE REPUBLICAN PARTY TREATS IT LIKE IT THEIR OWN THING THAT
THEY ARE PAYING FOR. DEMOCRATIC PARTY THE SAME WAY.
THE OPEN PRIMARY IS BEING SPONSORED BY TWO DEMOCRATS, NOT
SURPRISINGLY. I INTERVIEWED BOB PEARLS ON MY
AFTERNOON PROGRAM. I HAVE BEEN VERY IN TOUCH WITH
THE OPEN PRIMARY INITIATIVE AND THE REASON WHY IS BECAUSE YOU
HAVE A CHANGING IN TERMS IMPETUS VOTER REGISTRATION, CHANGING
POPULOUS. 20% OF THE PEOPLE HERE IN
BERNALILLO COUNTY, AND 20% IN NEW MEXICO, THEY ARE DECLINED TO
STATE. IF YOU TAKE THE GREENS AND OTHER
PARTIES, LIBERTARIAN PARTY, YOU HAVE NOW 25%.
SO, YOU ARE TALKING ABOUT, HEY, THIS ISN’T A SWING VOTE.
WE REACHED THAT MALCOLM GLADWELL TIPPING POINT, AND WHEN YOU LOOK
AT IT BROADER, LIKE, HOW MANY IMPETUS US ACTUALLY TAKE THE
TIME TO GO OUT AND REREGISTER TO VOTE?
OUR POLITICAL PHILOSOPHIES CHANGE, YOU KNOW, I AM STILL A
REGISTERED DEMOCRAT BUT I HAVEN’T BEEN HERE FOR REALLY
YEARS AND I DON’T PARTICIPATE IN ANY DEMOCRATIC PARTY POLITICS.
ANYBODY WOULD LOOK AT ME OR LISTEN TO WHAT I TALK ABOUT IN
THE AFTERNOON AND WOULD UNDERSTAND THAT I REGISTER
PRETTY MUCH MY IDEAS ARE BY AND LARGE PRETTY CONSERVATIVE AND A
LITTLE PALEO-LIBERTARIAN.>>PALEO.
I LIKE THAT.>>HERE IS THE CRUX IMPETUS IT,
42% IN MOST RECENT GALLUP POLL IDENTIFY THEMSELVES NEITHER WITH
THE REPUBLICAN OR THE DEMOCRATIC PARTY.

THEMSELVES. ONLY 26% IDENTIFY THEMSELVES
WITH REPUBLICANS AND 29% AS DEMOCRATS.
WHEN YOU THINK ABOUT THAT WE NEED TO GET EVERYBODY INVOLVED
IN THE PRIMARIES. THE REASON WHY IS THERE IS A
LACK IMPETUS INTEREST IN THE OVERALL A ELECTORATE.
THEY ARE NOT INTERESTED. YOU HAVE RECORD NUMBERS IMPETUS
PEOPLES NOT SHOWING UP TO POLLS.>>MIDTERMS, YEAH, EXACTLY

PART OF THE PROCESS. GET THEM INVOLVED EARLIER AND

I APPRECIATE WHAT EDDY JUST LAID OUT, BUT ARE PEOPLE WHO ARE
PARTY STALWART ACTUALLY GOING TO VOTE FOR THEIR OWN SORT IMPETUS
DEMISE HERE? IT GETS MURKY FOR PEOPLE, IF YOU
HAVE GOT PEOPLE ABLE TO VOTE IN PRIMARIES WHO ARE NOT
NECESSARILY A MEMBER OF THAT PARTY.

YOU KNOW. CITIZENS IMPETUS NEW MEXICO ABLE
TO VOTE FOR IT. THAT SAID, I KNOW THERE IS
CONCERN ABOUT SPOILERS AND THE IDEA THAT, SAY, FOR INSTANCE, A
LARGE GROUP IMPETUS DEMOCRATS OR A LARGE GROUP IMPETUS
REPUBLICANS WHO CROSS THE LINE AND VOTE IN THE OTHER PARTY’S
PRIMARIES, FOR SOMEONE WHO THEY MAY CONSIDER TO BE UNELECTABLE.
AND, SO, I UNDERSTAND AND APPRECIATE THIS SENTIMENT FROM
THE PARTIES LIKE LISTEN WE WANT PEOPLE WHO ARE ACTUALLY GOING TO
VOTE FOR US OR VOTE FOR OUR POLICIES AND CANDIDATES
PARTICIPATING IN THIS PRIMARY RATHER THAN PEOPLE WHO WERE
NEVER GOING TO VOTE FOR US AND WANT TO WEAKEN OUR CHANCES EARLY
IN THE GAME.>>BEFORE WE GET OUT IMPETUS
TIME. THREE STRIKES, IS OUT THERE.
I’M INTERESTED IN YOUR OPINION ON THE THREE STRIKES LAW AS IT
STANDS. THE LIST IMPETUS 12 ADDITIONAL
CHARGES, I DON’T THINK ANYBODY COULD ARGUE WITH THE 12
ADDITIONAL CHARGES, THOSE ARE ALL SERIOUS CRIMES.
TO YOUR POINT BEFORE ABOUT TEEN CURFEW, IS THIS MORE GRAND
STANDING OR COULD IT WORK FOR NEW MEXICO.

THE WORLD, WHAT WE ARE TALKING ABOUT IN TERMS IMPETUS PRISON
REFORM, DIFFERENT STYLE THAN WE SEEM TO BE TACKLING.
I THINK IT IS SYMBOLIC AND SOMETHING THAT YOU CAN TAKE
BACK — AGAIN, IT IS THIS THING THAT YOU CAN TAKE BACK TO YOUR
CONSTITUENTS. WE DON’T AGREE ON ANYTHING.
WHAT CAN WE AGREE ON? WELL, NOBODY LIKES CRIMINAL SO
WE CAN DO SOMETHING TO THEM. YOU KNOW.
>>I THINK THAT SOME OF THE PEOPLE THAT SAY THIS IS JUST
GRAND STANDING OR IT IS JUST SYMBOLIC, I DISAGREE WITH THEM
ON THAT ONE BECAUSE WHAT HAS BROUGHT THIS TO THE FORE ARE
VIOLENT REPEAT OFFENDERS AND WE TALK ABOUT PRISON REFORM, I AM
ALL FOR PRISON REFORM. A LOT IMPETUS PEOPLE ARE, BUT WE
ARE TALKING ABOUT PRISON REFORM FOR PEOPLE WHO HAVE COMMITTED
NONVIOLENT CRIME. THESE ARE GUYS, WHATEVER YOU
WANT TO CALL THEM, TURN-STYLE THUGS OR WHATEVER, AND HERE ON
NEW MEXICO INFOCUS, THIS PAST YEAR, AT THE END OF THE YEAR,
WHAT WAS THE NO. 1 TOPIC? NO. 1 TOPIC WAS CRIME
SPECIFICALLY IN ALBUQUERQUE. AND, PUBLIC SAFETY IS THE NO. 1
JOB FOR OUR POLITICIANS, FOR OUR ELECTED OFFICIALS.
>>ARE YOU COMFORTABLE WITH THE 12 ADDITIONAL CRIMES, SO TO
SPEAK, THAT WOULD MAKE THREE STRIKES.
MOST IMPETUS THEM ARE VIOLENT OFFENSES.

I THINK IT IS A REALLY HEALTHY DEBATE WORTH HAVING AND AS LONG
AS WE ARE TALKING ABOUT VIOLENT OFFENDERS.
